1. Introduction
These Terms & Conditions (hereinafter referred to as “Agreement”) govern your use of the TRVL° Photography website, services, and products. By accessing or using our website, services, or products, you agree to be bound by the terms outlined in this Agreement. This Agreement constitutes a legally binding contract between TRVL° Photography (owned and operated by Snell Media, Gregory John Snell, and Zoomtropical, Brendan Todd Van Son) and you, the User (hereinafter referred to as “You” or “User”).
This Agreement complies with all relevant and applicable legal provisions, including, but not limited to, the German Civil Code (Bürgerliches Gesetzbuch – BGB), the European Union’s General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679), and EU consumer rights legislation, including Directive 2011/83/EU on Consumer Rights and Directive 1999/44/EC on Consumer Guarantees.

All transactions, services, and interactions on the TRVL° Photography platform are governed by these Terms & Conditions.
4. Contract Formation
A legally binding contract between You and TRVL° Photography is established when You place an order on our website and provide the required deposit or full payment. By completing an order, You accept and agree to be bound by the terms of this Agreement.
For photography tour bookings, a deposit of 20% is required to secure your reservation, with the balance due 120 days prior to the tour’s start date. For merchandise purchases, full payment is required at the time of order.
5. Pricing, Payments, and Taxes
All prices on the TRVL° Photography website include VAT where applicable, in compliance with §13b UStG (German VAT Act) for EU customers. Customers outside the EU may be subject to customs duties, taxes, and import fees upon delivery, which are the responsibility of the customer.

By placing an order, You confirm that the payment information provided is accurate and that You are authorized to use the selected payment method. TRVL° Photography reserves the right to cancel any order where payment is not authorized or where fraudulent activity is suspected.
To reserve a space on a tour with TRVL you must pay the deposit. That deposit is generally 20% of the total tour cost. TRVL reserves the right to cancel the booking and refund the deposit in cases where necessary.
Once the deposit is complete, you will receive written confirmation of your booking as well as a receipt of the payment.
The final payment is due 120 days prior to the start date of the tour.
The deposit for a tour is refundable with a 25% fee as long as the cancellation request is received by TRVL at least 120 days prior to a booked tour’s start date. Alternatively, TRVL may offer to transfer your deposit to a future trip penalty free.
The exact refund date of a deposit depends specifically on a trip. In general, refunds on deposits are offered up to 120 days before a tour’s start date. But in certain cases, deposits become non-refundable before that. If that’s the case, TRVL will contact you via email with a minimum 10 day window before the deposit becomes non-refundable. This only happens when the deposit funds have already been used to book non-refundable tour logistics such as domestic flights or local operator confirmation pre-payments before the 120 day mark.
If you cancel a tour within 120 days of the tour’s start date, you will forfeit the deposit.
Invoices for final payments are issued 180 days before a tour’s start date with a due date of 120 days prior to a tour’s start date. If the final payment is not made by 120 days before the tour’s start date, TRVL reserves the rights to cancel your booking and you will forfeit your deposit.

Our TRVL Photography tour leaders reserve the right to dismiss any participants during a trip if they:
If TRVL needs to cancel a trip for any reason, we will refund the trip cost in full.
However, we urge you to pay for trip cancellation insurance before making any final payments as TRVL will not cover other costs such as flights, accommodation, food on route to your destination.
Note that TRVL will only cancel tours in situations where completing a tour is impossible or unsafe. For example, a natural disaster, pandemic, or political situation.
6. eCommerce: Product Availability, Orders, and Fulfillment
6.1 Availability of Products
All products listed on the TRVL° Photography website are subject to availability. While we strive to maintain accurate product listings, we cannot guarantee product availability at the time of your purchase. In the event that a product becomes unavailable after You place an order, we will notify You promptly and offer either a full refund or an alternative product of similar value.
6.2 Order Fulfillment
Orders are processed within 2–5 business days. Fulfillment times may vary based on the product type and order volume, but we aim to ship 97% of orders within 5 business days, and over 50% are typically shipped within 3 business days.
Upon placing an order, You will receive an order confirmation via email, as required under Article 7 of the Consumer Rights Directive (Directive 2011/83/EU).
6.3 Changes or Cancellation of Orders
Once an order has been placed, it cannot be altered or canceled unless You notify TRVL° Photography within 14 days. This can be done by submitting your right of withdrawal.
After this period, changes or cancellations may be subject to additional fees, and TRVL° Photography reserves the right to decline requests if the order has already been processed.
7. Shipping & Delivery
7.1 Shipping Methods and Costs
TRVL° Photography offers international shipping, with options such as express and standard delivery. Shipping costs and estimated delivery times vary by destination and distribution region (e.g., the US, Europe, Asia) and will be calculated at checkout.
While we strive to meet estimated delivery windows, these times are not guaranteed due to potential delays from customs, carrier issues, or other external factors.
7.2 International Shipping and Customs
For orders shipped outside of the European Union, additional charges such as customs duties, taxes, and import fees may apply. These costs are beyond our control and must be borne by the customer. Failure to pay these fees may result in the return of the package to TRVL° Photography, in which case shipping costs will not be refunded.
7.3 Risk of Loss
The risk of loss and title for products passes to You when the carrier accepts the shipment. In the event of lost or damaged shipments, You must file a claim directly with the carrier.
8. Returns, Refunds, and Cancellations
8.1 Return Window and Conditions
You are entitled to return most products within 14 days of receipt under the Consumer Rights Directive (Directive 2011/83/EU). However, customized or personalized products are not eligible for returns unless they are defective.
To initiate a return, You must notify us in writing within the 14-day window. Items must be returned in their original condition and packaging. TRVL° Photography reserves the right to refuse a refund if returned products show signs of wear or damage.
8.2 Return Shipping Costs
Unless otherwise stated, You are responsible for the cost of return shipping, except where the product is defective. It is recommended to use a trackable shipping method to ensure that the return is received.
8.3 Refund Processing
Refunds will be issued within 14 days of receiving the returned product and will be credited via the original payment method. If a refund cannot be processed for external reasons (e.g., payment processor issues), You will be notified immediately.
8.4 Order Cancellations
You may cancel your order within 14 days, provided the product has not yet been shipped. Cancellations after the product has been shipped or produced will incur a 25% administrative fee.
8.5 Defective or Damaged Goods
If a product arrives defective or damaged, You must notify TRVL° Photography within 7 days. We will arrange for a replacement or refund depending on the defect, and TRVL° Photography will cover the return shipping costs.
9. Delayed or Lost Shipments
Claims for lost packages must be submitted within 30 days of the estimated delivery date. If the package was lost during transit, we will reprint and reship at no additional cost. If tracking shows that a package was delivered but You claim not to have received it, TRVL° Photography is not responsible for reshipping. In such cases, any replacements will be at the customer’s expense.
10. Liability and Limitations
10.1 Limitation of Liability
TRVL° Photography shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or opportunities, arising from the use of our services or products. Our total liability to You shall not exceed the amount You paid for the products or services in question.
10.2 Third-Party Services
TRVL° Photography is not responsible for the performance or quality of third-party services, including but not limited to delivery, accommodation, or transportation services. Engaging with third-party providers is done at your own risk.
11. Dispute Resolution & Governing Law
All disputes arising from or related to this Agreement shall be governed by the laws of Germany and the European Union. Any disputes will be exclusively resolved in the courts of Hamburg, Germany.
11.1 Consumer Dispute Resolution
In accordance with Directive 2013/11/EU and Regulation (EU) No 524/2013, TRVL° Photography offers access to the EU-wide online dispute resolution platform, which can be accessed at https://ec.europa.eu/consumers/odr.
12. Modifications to the Terms & Conditions
TRVL° Photography reserves the right to modify these Terms & Conditions at any time. Any modifications will be published on the website and take effect immediately upon publication. Continued use of the website and services constitutes your acceptance of the revised Terms & Conditions.
13. Severability
If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
